Understanding employment classification: exempt vs. nonexempt

There are distinct differences between exempt and nonexempt employees. The federal Fair Labor Standards Act governs most of the workers in California and determines if employees are entitled to be paid according to minimum wage standards, including overtime pay, or whether they should be paid salaries. Workers who have concerns about employment misclassification and its affect on their pay checks may be interested in the difference between the two classifications.

The importance of paying attention to employment contracts

When people searching for new jobs are offered positions, it is understandably an exciting time.  Many employers in California offer contracts and apply pressure to the recipients to commit quickly. However, most employment contracts have boilerplate language that generally benefits the employer, and it could be important to a potential employee's interests to read, understand and run this language by an attorney prior to signing.

Employment dispute in California national park scandal

Yosemite National Park is considered one of most scenic national parks in California. Recently, however, it has come under scrutiny due to an employment dispute related to blatant harassment and intimidation under the leadership of Don Neubacher. Neubacher is the husband of Patty Neubacher, who was the regional director of the Pacific West Region, which covers 56 national parks located in 6 western states.

Wrongful termination suit filed against Wells Fargo

A class-action lawsuit was recently filed against the bank Wells Fargo in California, alleging unjust firing. According to former Wells Fargo employees who filed the suit, they were terminated or mistreated in other ways if they did not meet strict bank sales quotas. This led many employees to open millions of bogus consumer accounts, which in turn led to investigations, lawsuits and fines from various federal and state authorities. Whenever a person is a victim of wrongful termination, he or she has the right to take legal action against his or her former employer.
